When it comes to user-generated content, Cardzware understands the importance of clarifying its position regarding liability for any images uploaded by customers of merchants using our app. The below terms outline and emphasize Cardzware's non-liability stance, emphasizing the responsibility of users and merchants in ensuring the legality and appropriateness of uploaded images.
Terms and Conditions: Cardzware's Non-Liability and Content Review Policy
By using the Cardzware Print on Demand Greeting Card App for WooCommerce or Shopify, you the merchant agree to the following terms and conditions:
End User Responsibility:
1.1. Customers uploading images through the Cardzware app are solely responsible for ensuring they have the necessary rights, licenses, or permissions to use and upload such images.
1.2. Customers must comply with all applicable copyright laws, intellectual property rights, and privacy regulations when uploading images.
1.3. Customers shall not upload any images that contain offensive, explicit, or illegal content, including but not limited to content that infringes upon intellectual property rights, defames or violates privacy rights of any individual, promotes hate speech, or is otherwise unlawful.
Cardzware Non-Liability:
2.1. Cardzware cannot be held liable for any copyright infringement, intellectual property violation, or illegal content present in the images uploaded by customers through the Cardzware app.
2.2. Cardzware assumes no responsibility for verifying the legality, ownership, or appropriateness of the images uploaded by customers.
2.3. Cardzware shall not be liable for any damages, losses, or legal consequences arising from the use of copyrighted, infringing, or illegal images uploaded by customers.
Content Review and Right to Refuse Printing:
3.1. Cardzware reserves the right, but not the obligation, to review and evaluate the content uploaded by customers.
3.2. In cases where Cardzware becomes aware of any potentially infringing, illegal, or offensive content, Cardzware may refuse to print and fulfill any orders that contain such material.
3.3. Cardzware may, at its discretion, suspend or terminate services, disable access to the app, or take any necessary action to address infringements, violations, or offensive content.
Indemnification:
4.1. Merchants shall indemnify and hold Cardzware harmless from any claims, demands, actions, losses, damages, costs, and expenses (including legal fees) arising from the use of the Cardzware app, including but not limited to any copyright infringement, intellectual property violation, or unlawful content uploaded by customers.
Governing Law and Jurisdiction:
5.1. These terms and conditions shall be governed by and interpreted in accordance with the laws of the Republic of Ireland. Any disputes arising out of or relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of the Republic of Ireland.
By using the Cardzware Print on Demand Greeting Card App, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions. If you do not agree with any part of these terms and conditions, please refrain from using the Cardzware app.
